No. 35853 of 2015 to the extent of that other similarly situated accused persons subsequently granted anticipatory bail vide order dated 15.10.2015 passed in Cr. Misc. No. 45639 of 2015 by a coordinate Bench of this Court.
Considering the fact that the order passed in Cr. Misc. No. 45639 of 2015 was subsequent to the order passed in Cr. Misc. No. 35853 of 2015, this Court is not inclined to consider the prayer for modification but keeping in view of the fact that others have been granted anticipatory bail, let the learned court below consider the prayer for regular bail of the petitioners if they
Patna High Court Cr.Misc. No.7669 of 2016 (2) dt.17-02-2016 2/2 surrenders within a period of three weeks in connection with SC/ST (Patna) P.S. Case No. 11 of 2014 pending in the court of learned SDJM, Danapur, Patna.
It is expected from the learned court below to consider the prayer for regular bail of the petitioners preferably on the same day.
With the above observation, modification application is, accordingly, disposed off.
