Mr.Manoj Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-02-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bihiya P.S. Case No. 183 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. The allegation is regarding unknown miscreants having intercepted the motorcycle of the informant and snatched a sum of Rs. 26,710/- and other articles.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case inasmuch as his name has transpired on account of confessional statement made by the co-accused person and neither any recovery has been made from the petitioner nor T.I. Parade has been held so as to connect the petitioner with the alleged crime.

Patna High Court CR. MISC. No.11886 of 2019(2) dt.26-02-2019 2/2 It is submitted that though the petitioner is accused in two other cases but he is on bail in the said two cases. Lastly, it is submitted that the petitioner is languishing in custody since 05.11.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-5th Bhojpur, Ara in connection with Bihiya P.S. Case No. 183 of 2018.
