JUSTICE ANIL KUMAR SINHA ORAL ORDER 01-12-2021 The limited prayer made by the petitioner in the present writ application is to issue a direction to the District Magistrate, Saran, at Chapra, to dispose Arms License Case No. 127 of 2018, pending for issuance of arms license for revolver/pistol and rifle.

Learned Counsel for the petitioner submits that the aforesaid case is pending for consideration of application for grant of arms license submitted by the petitioner on 04.08.2017, but despite four years having been passed, the said case has not been disposed by the District Magistrate, Saran, at Chapra. As per Rule 13 of the Arms Rules, 2016, request for

Patna High Court CWJC No.6096 of 2020(2) dt.01-12-2021 2/2 license has to be decided within 60 days from the date of receipt of the police report.

Learned Counsel for the petitioner submits that the police report has already been submitted before the Licensing Authority.

On the other hand, learned Counsel for the State submits that the District Magistrate, Saran, at Chapra, may be directed to dispose the Arms License Case No. 127 of 2018 in accordance with law within a reasonable time frame. I have heard learned Counsel for the parties concerned and have also gone through the materials available on record. From perusal of the records, it appears that the Arms License Case No. 127 of 2018 is pending since 2018. Accordingly, the District Magistrate, Saran, at Chapra, is directed to dispose Arms License Case No. 127 of 2018 in accordance with law within a period of two months from the date of receipt/production of a copy of this order. With the aforesaid observation and direction, this writ application is disposed.
