Earlier, the petitioner was granted bail by this Court vide order dated 28.06.2011 passed in Cr. Misc. No. 17151 of 2011, taking note of this fact that petitioner was stranger to the family and husband of the deceased and also keeping in mind that husband and in-laws of the deceased had already been acquitted after full-fledged trial.
The impugned order goes to show that after grant of bail, the petitioner jumped bail, as a result of which his bail bond was cancelled on 18.03.2012. Moreover, the petitioner was arrested and remanded in this case on 07.12.2016. Submission on behalf of the petitioner is that petitioner
Patna High Court Cr.Misc. No.6664 of 2017 (2) dt.01-03-2017 2/2 was under impression that when the in-laws and husband of the deceased had already acquitted, he also might have been acquitted along with them and that was the reason, he did not attend the court and went outside the State in connection with his livelihood. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Shahkund P.S.Case No. 101 of 2005.
