Petitioner is accused in connection with Riga P.S. Case no. 139 of 2016 registered under Sections 399, 402 of the I.P.C., 25(1-B)A, 26, 35 of the Arms Act and sections 3/4 of the Explosives Substance Act.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Petitioner has no criminal antecedent. Petitioner has been implicated in this case falsely due to village politics. Petitioner has been arrested merely on suspicion. Petitioner is in custody since 05.07.2016. similarly situated co-accused persons have been granted bail by this Court vide orders dated 21.11.2016,

Patna High Court Cr.Misc. No.10867 of 2017 (2) dt.28-03-2017 2/2 22.11.2016 and 15.12.2016 passed in Cr. Misc. Nos. 50259 of 2016, 50358 of 2016 and 53943 of 2016 respectively. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Riga P.S. Case No. 139 of 2016.
