2. In this case, the petitioner is seeking regular bail in connection with Sakra P.S. Case No. 552 of 2024, registered for the offences punishable under Section 137(2) of the BNS, 2023 and later on, section 103, 238, 61(2) of BNS, 2023 was added.

3. According to the FIR, the son of the informant went out from his house, saying that he was going to watch a fair, but he didn't return. The deceased had a conversation with his mother through his mobile number 9122099690, but thereafter the mobile set was found switched off.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.12032 of 2025(3) dt.16-05-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that three accused persons, namely Himanshu, Sahil and Manish Kumar, have rendered their confessional statement, and they have categorically stated that they had committed murder of the deceased by slitting his throat with a knife. It has also been submitted that the miscreants who committed the crime, have not named the present petitioner, in their confessional statements. The petitioner has been made accused only on the basis that the petitioner had a conversation using the mobile set of the deceased.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the complicity of the present petitioner also transpires from perusal of the case diary because he had conversation using the mobile set of the deceased.

6. The three accused persons namely Himanshu, Sahil and Manish Kumar, who committed the murder of the deceased, have not named the present petitioner in the alleged occurrence. The petitioner is a person of clean antecedent and is under custody since 05.11.2024.

7. Considering the above-mentioned facts and

No.12032 of 2025(3) dt.16-05-2025 3/3 circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 15th Muzaffarpur in connection with Sakra P.S. Case No. 552 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
