====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Karpi (Shahar Telpa) P.S. Case No. 108 of 2018, instituted for the offence under Section(s) 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code.

Counsel for the petitioner submits that there is general and omnibus allegation against the petitioner in the written report.

It is alleged in the written report that villagers chased the informant and his uncle Surendra Yadav on the pretext that they have stolen the buffalo of Indal Ram(petitioner). It is further alleged that the mob of several persons brutally assaulted the informant and his uncle. The uncle of the

Patna High Court CR. MISC. No.11493 of 2019(2) dt.26-02-2019 2/2 informant died on the way to hospital. The informant was taken to Hospital for treatment.

In this manner, from the written report it appears that general and omnibus allegation has been levelled against the petitioner that petitioner along with 100 unknown persons have committed murder of father of the petitioner. Petitioner is in custody since 20.7.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Krishna Kumar Chaudhary, learned Additional Chief Judicial MagistrateIV, Arwal, in connection with Karpi (Shahar Telpa) P.S.
