JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-03-2017 The opposite parties No. 1 to 4 have been granted anticipatory bail by an order dated 07.01.2017 passed by learned 2nd Additional Sessions Judge, Madhubani in A.B.P. No. 1313 of 2016 in connection with Ladaniya P.S. Case No. 105 of 2016 registered for the offence punishable under Sections 323, 341, 324 and 307/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner, who is informant of the case, has submitted that there being allegation of assault made by the petitioner on the head of the informant, the court below considering the seriousness of the offence ought not to have granted privilege of anticipatory bail.
Patna High Court Cr.Misc. No.10811 of 2017 (2) dt.06-03-2017 2/2 Upon perusal of the First Information Report and considering other materials on record, I do not find it to be a case of wrong exercise of discretion by the court below while allowing opposite parties No. 2 to 4 privilege of anticipatory bail.
