JUSTICE BIRENDRA KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 370/34 of the Indian Penal Code and Section 79 of the Juvenile Justice Act, 2015. Allegation against the petitioner is that he was carrying two children for labour work.
Petitioner has stated on oath that he has got no criminal antecedent and is in custody since 21.01.2017. In fact the children were going to Surat to meet their uncle and brother with the consent of their parents.
Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail
Patna High Court Cr.Misc. No.13253 of 2017 (3) dt.12-04-2017 2/2 bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Samastipur/Successor Court, in connection with Darbhanga (Sitamadhi) P.S. Case No.6 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
