JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 The petitioner apprehends his arrest in connection with Khagaria (Gangore) P.S.Case No. 904 of 2018 registered under Sections 272 and 273 of the Indian penal Code and 30(a)/37(b) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is that from his hut, 9.6 litres of country made liquor was recovered and some persons were found taking liquor there and some of them have been arrested.

Submission of learned counsel for the petitioner is that allegation is false and concocted and hut does not belong to the petitioner and he has no criminal antecedent. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,

Patna High Court CR. MISC. No.11873 of 2019(2) dt.27-02-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Khagaria in connection with Khagaria (Gangore) P.S. Case No. 904 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
