2. This application is for grant of regular bail in connection with Pothia P.S. Case No.55 of 2024, registered for the offences under Sections 363, 365, 366A, 34 of the Indian Penal Code but charge sheet has been submitted under Section 366 of Indian Penal Code and Section 12 of POCSO Act.
3. As per the F.I.R., the victim girl is alleged to have been abducted by the petitioner.
4. Learned counsel for the petitioner submits that when the police found the victim and the petitioner, they started to run away. It appears that the victim had eloped herself
Patna High Court CR. MISC. No.13965 of 2025(3) dt.13-05-2025 2/2 otherwise she would not have started running after seeing the police. The petitioner is in custody since 17.05.2024 and he claims clean antecedent.
5. Considering the facts and circumstances of the case, this application is allowed.
6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge Ist-cum-Special Judge, Kishanganj/concerned Court below, in connection with Special (POCSO) Case No.34 of 2024, arising out of Pothia P.S. Case No.55 of 2024.
