JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-09-2022 Though the present writ petition was filed for quashing the notice dated 11.9.2016, issued by the Circle Officer, Bankatwa Anchal, District-East Champaran by which the petitioner was directed to remove the encroachment from the land in question, however, during the pendency of the present writ petition, the petitioner has died, hence, apparently, the said notice dated 11.9.2016, if not already acted upon, has become redundant in the eyes of law.

In such view of the matter, the learned

Patna High Court CWJC No.24562 of 2018(2) dt.13-09-2022 2/2 counsel for the deceased petitioner seeks liberty on behalf of his legal heirs to pursue any subsisting cause of action, in accordance with law. Liberty, so sought, is granted.

The writ petition stands disposed of.
