The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged that 22.50 quintals of rice being transported through the truck in 45 bags along with 91 empty bags were seized and two persons namely Ali Akbar and Kamruddin being driver and khalashi were apprehended, who disclosed that the rice belongs to Shambhu Rai which has been purchased by the petitioner.

It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the petitioner purchased the alleged rice. Statement has been made in para-3 of the petition that petitioner has no criminal

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S.
