The petitioner seeks bail in a case instituted for the offence under Sections 20 and 22 of the N.D.P.S. Act. It has been submitted that 360 gm. of Ganja is said to be recovered from possession of this petitioner. The petitioner is in custody since 29.10.2016. It has further been submitted that petitioner is a handicapped person.
In terms of Section 20 of the N.D.P.S. Act, the maximum punishment for small quantity is with Rigorous Imprisonment for six months or with fine, which may extend to ten thousand rupees.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.5662 of 2017 (2) dt.23-02-2017 2/2 the case, prayer for bail of the petitioner is allowed. let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Bhagalpur, in connection with Akbar Nagar P.S. Case No. 112 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner.
