Petitioner is accused in connection with Maranchi P.S. Case No. 70 of 2018 registered under Section 302 of the Indian Penal Code and Section 27 of the Arms Act pending in the Court of Additional Chief Judicial Magistrate-IV, Barh. Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and there is no specific allegation of assault or firing levelled against the petitioner.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that the petitioner is named accused and the petitioner has got criminal antecedent.

Patna High Court CR. MISC. No.13025 of 2019(3) dt.11-04-2019 2/2 Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, liberty is granted to the petitioner to renew his prayer for bail after framing of charge.
