The petitioner seeks bail in Manjhi P.S. Case No.228 of 2015 instituted for the offence under Section 395 of the Indian Penal Code.
It is alleged that Dacoity has been committed in the house of informant and about 10 unknown Dacoits took away various articles including ornaments and Rs.15,000/- cash. The petitioner is not named in the FIR.
From the impugned order it appears that the name of petitioner has come in the confessional statement of co-accused as mentioned in paragraph 52 and 78 of the case diary. It has been submitted that other co-accused has been
Patna High Court Cr.Misc. No.4366 of 2017 (2) dt.10-02-2017 granted bail by a co-ordinate Bench of this Court by an order dated 8.9.2016 passed in Cr.Misc.No.30607 of 2016. The petitioner is said to be in custody since 30.11.2015. It is mentioned in paragraph 3 of the petition that the petitioner has no criminal antecedent.
In the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Saran at Chapra in connection with Manjhi P.S. Case No.228 of 2015, subject to the conditions that both the bailors shall be the close relative of the petitioner.
