The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code.

Allegation against the accused persons is of committing loot.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.06.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. The petitioner used to take care of lichi orchard of the informant. There was certain disputes between the petitioner and the informant, which led to

Patna High Court CR. MISC. No.11555 of 2019(3) dt.12-04-2019 2/2 institution of the present case. There is no recovery of any incriminating article from the possession of the petitioner. Other co-accused has been granted bail vide Cr.Misc.No.11537 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge, Naugachia in the district Bhagalpur in connection with Sessions Trial No.805 of 2018 corresponding to Bihpur P.S. case No.196 of 2018.
