JUSTICE PARTHA SARTHY ORAL ORDER 19-07-2021 Heard learned counsel for the petitioners and learned A.P.P for the State through video conferencing. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Shambhuganj P.S. Case No. 186 of 2019, registered under sections 467, 468, 471, 419, 420 and 120B of the Indian Penal Code.

As per prosecution case, the accused persons including four petitioners herein obtained their appointment/selection as Anganbari Sevika in different Anganbari Kendra on the basis of

It is submitted by learned counsel for the petitioners that so far as the marksheet produced by these petitioners are concerned they were genuine. Further none of the petitioners have joined as Anganbari Sevika nor have they received any monetary benefits. The case of the petitioners stands on a similar footing to that of co-accused Nilu Kumari and Rupa Kumar who have been enlarged on bail vide order dated 13.11.2019 passed in Cr. Misc. no.65487 of 2019. The petitioners have no criminal antecedent.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations together with the submission made on behalf the petitioner, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of six weeks from today and in the event of their arrest or surrender in connection with Shambhuganj P.S. Case No. 186 of 2019, they will be enlarged on bail on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief
