The petitioner is accused in connection with Samastipur Rail P.S. Case No. 57 of 2016, registered under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, it has come that the looted mobile was being used after inserting SIM of one Fulo Yadav of village Simri, Darbhanga and the said mobile set was also used for talking with this petitioner. Thereafter, Police reached at the mobile repairing shop of the petitioner and the looted mobile is said to be recovered. Further submission is that petitioner used to run a mobile repairing

Patna High Court Cr.Misc. No.3915 of 2017 (2) dt.23-02-2017 2/2 shop and the alleged mobile set was put at the shop of the petitioner for repairing. The petitioner has no criminal antecedent is in custody since 10.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate (Rail), Samastipur in connection with Samastipur rail P.S. Case No. 57 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
