The petitioner seeks bail in a case registered under Sections 302, 379, 120(B)/34 of the Indian Penal Code. Allegation is that the accused persons committed murder of the brother-in-law of the informant by means of lathi and danda.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.11.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no eye witness to the alleged occurrence. The death of the deceased has been explained by the

Patna High Court CR. MISC. No.11609 of 2019(3) dt.01-05-2019 2/2 niece of this petitioner, who had instituted a case for an offence under Section 376 of I.P.C. against the deceased. On the date of occurrence, the deceased had gone to the niece of the petitioner and tried to commit rape. On hulla made by the niece, other family members gathered. The deceased was assaulted and later on he succumbed to the injuries.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh in connection with Maranchi P.S. case No.83 of 2016.
