JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pandarak P.S. Case No. 109 of 2018 registered for the offences punishable under Sections 323, 307, 420, 498A/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
On appearance of opposite party No.2 the matter was referred to Mediation and Conciliation Centre and report of Mediator at Flag 'M' disclosed that dispute has been resolved through process of mediation on the terms that petitioner shall pay Rs.10 lac as one time alimony in three instalments, first instalment of Rs.3 lac on the date of listing of the case through Bank Draft and further two instalments of Rs.3 lac and Rs.4 lac
Patna High Court CR. MISC. No.15708 of 2019(6) dt.16-11-2019 2/3 will be paid at the internal of three months each to the Bank Account of opposite party No.2, who was ready to furnish Bank Account number to the petitioner on the first date of listing of the case. Both the parties have admitted the above fact and it is stated that opposite party No.2 has not supplied her Bank Account number.
Heard learned APP and learned counsel for opposite party No.2.
In view of above facts and circumstances, opposite party No.2 is directed to supply her Bank Account number to the petitioner and to the court below preferably within two weeks, on that let petitioner surrender in the court below on 27.11.2019 along with Bank Draft, on that day opposite party No.2 shall remain present in the court and petitioner shall hand over the Bank Draft of Rs.3 lac in favour of opposite party No.2 to her and on that petitioner shall be released on provisional bail for a period of six months by the court below and during that period petitioner is directed to pay rest of the amount to opposite party No.2 through Bank Draft in favour opposite party No.2. Once total amount is paid by the petitioner, the provisional bail granted to the petitioner shall be confirmed by the court below. It is also made clear that both the parties shall have to abide by

This application is, accordingly, disposed of. Let a copy of the Mediator's report along with memorandum of agreement be sent to the court below for needful.
