NILU AGRAWAL ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in jail since 23.06.2016 in a case registered for offences punishable under Section 392 of the Indian Penal Code.

The prosecution case is that the informant, who is a businessman after collecting money, he was returning on his motorcycle and reached near Salhaur Bazar, four persons riding on two motorcycles intercepted him and took away Rs. 2,08,000/- from his possession.

It has been submitted by the learned counsel for the petitioner that he is not named in the F.I.R., nothing has been recovered from his possession and no T.I.P. has been done so

Patna High Court Cr.Misc. No.6472 of 2017 (3) dt.15-03-2017 2/2 far. It has further been submitted that just because he has criminal antecedent, he has been taken on remand in the present case. He submits that charge sheet has already been submitted, hence there is no chance of tampering with the prosecution evidence. Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstance of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction of learned 7th Additional Chief Judicial Magistrate, Siwan in connection with Pachrukhi (O. Sarai) P. S. Case No. 13 of 2016 with a condition that one of the bailors must be a close relative of the petitioner and the other bailor would have sufficient immovable property within the jurisdiction of the concerned police station and the petitioner is directed to appear before the learned Court below on each and every date and failure to appear before the Court below on two consecutive dates without assigning any reason will entail cancellation of his bail bond.
