2. The petitioner has preferred this application for grant of regular bail in connection with Sidhwaliya P.S. Case No. 305 of 2024 registered for the offences punishable under Section 317(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution story, on 22.10.2024, while checking the vehicle, Police caught a person with motorcycle. The Police team stopped him and asked to produce the document of motorcycle but he did not produce the same. On interrogation, the accused person disclosed that the motorcycle was stolen and he had no documents.

4. Learned counsel for the petitioner submit that petitioner is innocent and has falsely been implicated in this case. The petitioner has not committed any theft nor the alleged motorcycle is stolen one. Petitioner was apprehended merely on allegation of not producing any papers regarding the said motorcycle. Petitioner is in custody since 23.10.2024. Learned counsel further submits that after completion of investigation, charge-sheet has been submitted against the petitioner.

5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail after framing of charge, if charge not framed on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Sidhwalia P.S. Case No. 305 of 2024, subject to the following conditions :- (i). One of the bailors should be close relative of the petitioner.

(ii). Petitioner shall co-operate in the trial and shall be present on each and every fixed date and on his absence on two
