This is an application for bail in connection with Saharsa Sadar P.S.Case No. 562 of 2016 registered for the offences punishable under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act.
It has been submitted on behalf of the petitioner that even from the FIR there is no motive behind the occurrence and it appears to be an accidental firing causing injury to the injured and there is no intention of the petitioner to kill the injured and he is in custody for four months.
Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and in view of the fact that
Patna High Court Cr.Misc. No.5795 of 2017 (3) dt.17-03-2017 2/2 there is direct allegation against the petitioner of firing causing grievous injuries to the informant, at this stage I am not inclined to grant bail to the petitioner.
However, trial court is directed to expedite the trial and try to conclude it within a period of six months. If the trial is not concluded within the said period the petitioner will be at liberty to renew his prayer for bail before the court concerned. Accordingly, this application is dismissed.
