JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-06-2020 Heard learned counsel for the petitioner and the State as well as counsel appearing on behalf of the Accountant General, Bihar.

The petitioner claims that he has worked for more than 10 years under work charge establishment. It is submitted by learned counsel for the State with

Patna High Court CWJC No.4781 of 2020(2) dt.24-06-2020 2/2 reference to the statements made in paras 5 and 7 of the writ petition that the petitioner has worked as seasonal employee. Considering the fact that the Full Bench of this Court has already adjudicated the issue as to entitlement of those who have worked for more than 10 years in work charge establishment in the case of Mobina Khatoon Vs. The State of Bihar and Ors.: 2019(1)PLJR 1011, the writ petition is disposed of with direction to the respondents to verify the record and if it is found that the petitioner has actually worked in work charge establishment for more than 10 years, the respondents shall take appropriate decision for payment of pension in terms of the judgment of the Full Bench of this Court in the case of Mobina Khatoon (supra) and ensure payment thereof to the petitioner at the earliest preferably within a period of four months from the date of receipt/production of a copy of the order.

With the aforesaid, the writ petition stands disposed of.
