JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,354,307,379,504 and 506 of the Indian Penal Code and sections 3(1)(v)(x) and (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. It is alleged that the accused persons came at the door of the informant, made objection with regard to the purchase of land and abused him by calling the caste name when the wife of the informant came then she was also assaulted and abused by calling the caste name. Co accused Tuntun Shukla took away cycle worth

It is submitted by the learned counsel for the petitioners that the petitioners purchased three decimals of land on 9.1.2014 from one Nagina Pandey. Subsequently, the informant purchased same plot of land from Indu Devi on 18.1.2014 and in the background of such land dispute, the accusation has been levelled. It is further submitted that admittedly the occurrence took place at the door of the informant which cannot be treated a place of public view.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM, East Champaran at Motihari in connection with SC/ST P.S. Case No. 76 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
