JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Madanpur Police Station Case No. 229 of 2014 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 427, 379 of the Indian Penal Code.

In course of investigation, the further statement of injured informant was recorded at para-29 of the case diary and similarly statement of injured Ajit Kumar Gupta was recorded at Para 30 of the case diary and both the above stated injured stated that petitioner no. 1 Pankaj Kumar as well as petitioner no. 3 Anil Kumar had not taken part in assaulting the informant and injured

Patna High Court Cr.Misc. No.12226 of 2015 (3) dt.06-05-2015 2/2 and they were only present along with others on the place of occurrence at the time of alleged occurrence but they were empty hands. So far as, petitioner no. 2 namely, Rajesh Paswan is concerned, the above stated witnesses stated that one Rajesh Paswan son of Ram Raj Paswan was assaulting the informant and other injured.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact, that petitioners do not have any criminal antecedent, let petitioners in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Madanpur Police Station Case No. 229 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
