JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Nirmali P.S. Case No. 13 of 2017 for offences under Sections 460 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that the petitioner is neither driver of Tata pickup van nor he has collected money on behalf of the informant as transportation cost.

Considering the fact that the petitioner has been declared absconder, this Court is not inclined to grant bail to the petitioner. The application is rejected.

However, liberty is granted to the petitioner to

Patna High Court CR. MISC. No.12488 of 2020(2) dt.06-03-2020 2/2 surrender before the court below and pray for regular bail. In the event the petitioner surrenders and prays for regular bail, the same shall be considered and disposed of the same on its own merits on the same day without being prejudiced by the order of rejection of this application.
