The petitioners apprehend their arrest in connection with Nagar P.S. Case No.102 of 2018/G.R. No.733 of 2018 registered under Sections 366(A) and 120(B) of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant by Sunny Rajak alias Kumar with the help of his other family members.

Learned counsel for the petitioners submits that, in fact, the daughter of the informant left her parental house according to her own sweet will with Sunny Rajak alias Kumar, who is the son of the petitioner no.1 and the brother of the petitioner no.2 but with an

Patna High Court CR. MISC. No.11201 of 2019(3) dt.16-05-2019 2/2 ulterior motive, the informant has lodged the present case implicating the whole family members of Sunny Rajak alias Kumar. Furthermore, in her statement recorded under Section 164 of the Code of Criminal Procedure, the daughter of the informant has stated that she left her parental house with Sunny Rajak alias Kumar according to her own sweet will and she has not disclosed the name of the petitioners having hand in her kidnapping. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Nagar P.S. Case No.102 of 2018/G.R. No.733 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
