2. The petitioner has preferred this application for grant of regular bail in connection with Mahua P.S. Case No. 09/2024 dated 09.01.2024 registered for the offences punishable u/ss 302, 324, 307 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused person are alleged to have assaulted the informant's grandson and one Sonu Kumar with Fasuli due to that the informant's grandson died during the course of the treatment.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The informant is not the eyewitness to the alleged occurrence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.01.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. It is further stated that as per para 16 of the case diary, the petitioner used to sell toddy from his shop illegally and the deceased and Sonu Kumar used to come to his shop. On 07.01.2024, the deceased and Sonu Kumar ridden on the motorcycle came and demanded money forcibly, due to that the dispute arose and in the meantime, the petitioner inflicted blow of Fasuli in the stomach of the deceased causing cut injury and he also inflicted blow of Fasuli in the stomach of Sonu Kumar causing injury and said weapon was hidden beneath the bed and at the instances of the petitioner/accused, the said weapon used in the crime was recovered beneath the bed of the petitioner.

6. Considering the aforesaid facts and

7. The application stands rejected.
