JUSTICE ARVIND SRIVASTAVA ORAL ORDER 03-04-2017 Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner is accused in connection with Bakhtiyarpur P.S. Case No. 196 of 2016 registered under Sections 341, 323, 354A, 354B, 504, 509 of the I.P.C. and section 8 of the POCSO Act.
Learned counsel for the petitioner submits that petitioner is innocent, has committed no offence and has been falsely implicated in this case. Petitioner is in custody since 06.08.2016. Except section 354B, all other sections are bailable. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submit that there is direct allegation against the petitioner.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.7755 of 2017 (3) dt.03-04-2017 2/2 case and the rival submissions of the parties, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected.
However, petitioner may renew his prayer for bail after framing of charge.
