2. The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 227 of 2024 registered for the offence under Sections 64(1), 3(5) of the BNS and under Section 4 and 6 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of committing rape with a 14 year old minor girl.

4. The petitioner is in jail since 20.11.2024.

5. Learned counsel for the petitioner has submitted that out of eight charge-sheeted witnesses, two witnesses i.e. the victim and mother of the victim, have been examined in the trial

Patna High Court CR. MISC. No.14516 of 2025(4) dt.23-07-2025 2/2 and they have turned hostile.

6. Learned APP for the State has opposed the application of the petitioner.

7. In view of the facts of the case and also in view of the Judgment of the Hon'ble Supreme Court in the case of X Vs. State of Rajasthan and Anr. reported in 2024 SCC OnLine SC 3539., this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this application is dismissed.

9. The trial of the petitioner is directed to be expedited.
