The petitioners seek bail in a case instituted under Sections 323, 307, 384, 379 and 504/120B of the Indian Penal Code.

The allegation is that the petitioners along with others caught hold the informant and with an intention to kill, started assaulting him until he became unconscious. It is also alleged that the accused persons also snatched his mobile. It is further alleged that when the informant regained his sense, he found himself in the room of the accused persons and co-accused Raj Kumar Ram amputated his penis by knife and thereafter during treatment he died.

Patna High Court Cr.Misc. No.6911 of 2017 (2) dt.09-03-2017 It has been submitted on behalf of the petitioners that the petitioners are in custody since 21.10.2016. The charge sheet has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. It is a case and counter case between the parties. Both the parties are agnates. Due to property dispute, the alleged occurrence is said to have been taken place. The other co-accused has been granted bail vide Annexure4 to the present application. On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Gopalganj, in connection with Mohammadpur P.S. Case No. 152 of 2015.
