2. Since both applications arise from the same P.S. case number, they have been heard together and are being disposed of by this common order.
3. The petitioners apprehend arrest in connection with
Patna High Court CR. MISC. No.12630 of 2025(2) dt.02-04-2025 2/3 Lalganj PS Case No. 34 of 2024 dated 19-02-2024 instituted for the offence punishable under Sections 341,323,324, 307, 504 and 506/34 of the Indian Penal Code.
4.The prosecution case, in short, is that on 19-02-2024, while the informant was on his way to immerse the idol of Goddess Saraswati at the banks of the Gandak river, he was confronted by the accused persons, who arrived armed with lathi, danda, and iron rods and started abusing and assaulting him with fists and slaps. It is also alleged that they threatened to endanger his life and cause serious injury before fleeing the scene.
5. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that the allegation of assault has been made against seven named accused and 4-5 unidentified persons, with no specific overt act attributed to the petitioners. The doctor has stated in the injury report that the injuries sustained by all the injured persons are simple in nature, although they are on the vital parts of their bodies. Lastly, it is submitted that the petitioners in both cases have no criminal antecedents.
6. Learned A.P.P. for the State has opposed the prayer
Patna High Court CR. MISC. No.12630 of 2025(2) dt.02-04-2025 3/3 for anticipatory bail of the petitioners.
7.Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners of both cases be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Vaishali at Hajipur, in Lalganj PS Case No. 34 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
8. The applications stand allowed.
