2. The present petition has been preferred for the following relief(s):

"for issuance of an appropriate writ in the nature of mandamus commanding the respondents to issue Parwana in terms with Army Settlement Case No. 01 of 2016-17 in favour of the petitioner forthwith and also for a direction to authority concerned Parwana be give effect too by handing over the possession to the petitioner with all consequential benefits in terms thereof for which petitioner is entitled for."

3. Affidavits have come in the present case showing that the land which earlier the petitioner wanted being disputed cannot be settled.

4. By way of reply to the counter-affidavit, the petitioner has brought on record the letter no. 2453 dated 04.12.2021 issued by the Additional Collector to the Rural Officer Public Grievance Committee, Khagaria stating that a fresh proposal has come to Circle, Parbatta, Mauza - Saudh, Thana - 347, Khata 1160, Khesra 586 (Area 0.06 decimal) which is a Gairmazarua Khas land.

5. Learned counsel for the petitioner submits that it will suffice if the said recommendation of the Circle Officer, Parbatta is taken to its logical conclusion.

6. Learned State counsel do not have any objection to the petitioner moving before the highest authority of the district namely, the Collector, Khagaria (respondent no. 2).

7. In that background, this Court would like the Collector, Khagaria (respondent no. 2) to look into the matter and take the same to its logical conclusion, if still not taken.

8. The petitioner is well advised to file a fresh petition alongwith all the supporting document which he has brought on record by way of reply to the counter-affidavit in next four

9. If such petition is filed, the Collector, Khagaria shall be taking the matter to its logical conclusion at an earliest.

10. With the aforesaid observation, the writ petition stands disposed of.
