Petitioner seeks bail in connection with Dalsinghsarai P.S. Case No. 400 of 2020 registered for the offences punishable under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code and Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016.

According to prosecution case, the informant along with other police officials during patrolling intercepted a pick up van and recovered 630 litres illicit liquor.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence and he has falsely been implicated in the present case. Learned counsel further submits that nothing has been recovered from possession

Learned counsel further submits that petitioner is neither owner nor driver of the pick up van. Name of the petitioner came in confessional statement of co-accused. Petitioner is in custody since 20.01.2021.

The learned Additional Public Prosecutor opposed the prayer of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum Special Judge, Excise Samastipur in connection with Dalsinghsarai P.S. Case No. 400 of 2020 (Computer Registration No. 01 of 2021).
