JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2017 Learned counsel for the petitioner is permitted to make necessary correction in paragraph-11 of the bail petition. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mirganj P.S. Case No. 36 of 2000 instituted for the offence under Sections 399, 402 of the Indian Penal Code, Sections 25(1-A)B, 26 and 35 of the Arms Act.

There is allegation that accused persons were making planning for dacoity and on chase, one person namely, Vijay Kumar Tiwari was apprehended who took the name of this petitioner before the police as mentioned in the written report. It is apparent from the written report itself that no any incriminating article has been recovered from possession of this petitioner.

Patna High Court Cr.Misc. No.9146 of 2017 (4) dt.01-05-2017 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 36 of 2000, subject to the condition that both the bailors will be the close relatives of the petitioner.
