JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being the younger brother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 498A, 304B and 201/34 of the Indian Penal Code.
The prosecution case is of killing the sister of the informant after about three years of the marriage for nonfulfillment of the dowry demand. It is alleged against the petitioner that when the informant enquired about the torture being inflicted then he asked the informant to fulfill the dowry demand. It is submitted by learned counsel for the petitioner that the petitioner claims to be separate from the husband of the victim and the accusation is omnibus and general against entire in-laws
Patna High Court Cr.Misc. No.7866 of 2016 (3) dt.16-05-2016 2/2 family including the petitioner. Thrust of accusation is against the husband of the victim who is in custody.
It is submitted by learned counsel for the informant that the driver of the pickup van who took the dead body to the cremation place suggested that the petitioner was also present during cremation.
Considering the thrust of accusation against the husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV at Buxar in connection with Simri P.S. Case No. 182 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
