The petitioner seeks regular bail in connection with S.Tr. No.20 of 2014 arising out of Malaypur P.S.Case No.29 of 2013 registered for offences punishable under Sections 364, 302, 201 and 34 of the Indian Penal Code.

The case is under Section 302/34 of the IPC. It appears that the petitioner had earlier moved before this Court for grant of bail, which was rejected by this Court.

It is submitted on behalf of the petitioner that now all the witnesses have been examined and nothing has come against the petitioner, as such he may be enlarged with condition not to misuse privilege of the bail.

No.13638 of 2017 (3) dt.03-05-2017 2/2 Having heard both sides and in view of report of the court concerned showing that all the witnesses have been examined in this case including the informant, Doctor and the I.O. of the case and the case is pending only for evidence of one witness, who is B.D.O. It has further been submitted that the trial is likelihood to be concluded within a period of three months. In view of the facts as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to get the case concluded within the period, as specified by the Court. With the aforesaid observation, this application is dismissed.
