JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273, 420, 467 and 120B/34 of the Indian Penal Code and Section 47(a)(e)(f) of the Excise Act.

The house of the petitioner was raided on the information that illicit liquor was being manufactured when one Birendra Singh @ Birendra Yadav was apprehended who confessed that the petitioner and others escaped from the scene. From the house of the petitioner, sealing machine, gas cylinder and other articles were recovered.

It is submitted by learned counsel for the petitioner that the recovery does not constitute any offence either under the provision of IPC or Excise Act.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Nawanagar P.S. Case No. 241 of 2014 pending in the court of learned CJM, Buxar.

Accordingly, the application is disposed of.
