JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448 and 302/34 of the Indian Penal Code.
It is alleged that the petitioner entered into the house of the informant and assaulted his mother, as a result of which she died.
It is submitted by the learned counsel for the petitioner that the mother of the informant was 70 years old and died natural death and the postmortem report reflects no external or internal injury and death due to cardiac arrest. It is further submitted that the nephew of the informant was accused in Telhara P.S. Case No.
Patna High Court Cr.Misc. No.13362 of 2015 (2) dt.01-04-2015 2/2 72 of 2014 registered under sections 448 and 384(A) IPC when the nephew of the informant raised modesty of the niece of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the postmortem report does not corroborate the accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Hilsa, Nalanda in connection with Telhara P.S. Case No. 73 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
