The petitioner seeks bail in connection with Bhagwanpur P.S. Case No.238 of 2023 registered for the offence under Sections 302/34 of the Indian Penal Code. 3.

Allegation against the petitioner is to have committed murder of son of the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case, where, petitioner is not named in the FIR and name the petitioner surfaced on the basis of information of police spy. It is submitted that It is submitted that

Patna High Court CR. MISC. No.16118 of 2024(2) dt.26-04-2024 2/2 similarly situated co-accused person has already been granted bail by this Court through Cr. Misc. No.15780 of 2024 on 13.03.2024 and Cr. Misc. No.30477 of 2024 on 19.04.2024. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 04.01.2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Bhagwanpur (Tiyay) P.S. Case No.238 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Begusarai.
