The petitioner, already in custody, seeks bail in connection with Rail/Kiul P.S. Case No. 14 of 2017 registered under Sections 30(A), 38 (1) of the Bihar Excise (Amendment) Act, 2016.

Allegation in brief is that the Police recovered illegal country made liquor kept in sacks under the seat of bogie of the train and it is alleged that the petitioner was carrying the said illicit liquor.

Learned counsel appearing on behalf of the petitioner submits that so many passengers were travelling and sitting in the said bogie, but the petitioner was apprehended

Patna High Court Cr.Misc. No.9889 of 2017 (3) dt.15-03-2017 2/2 merely on suspicion and a similarly situated accused, namely, Rahul Kumar was earlier granted bail by this Court vide Criminal Misc. No. 9246 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Arun Kumar Yadav, is also directed to be released on bail upon furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Kiul at Lakhisarai in connection with Rail/Kiul P.S. Case No. 14 of 2017.
