2. In this present case, the petitioner seeks bail in connection with Triveniganj P.S. Case No. 300 of 2024 registered for the offences under Sections 109 and 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per prosecution case, minor son of the informant brought a loaded pistol in his school and fired upon the minor son of the informant who received injury in his left palm.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Police is yet to recover the pistol allegedly taken away by the petitioner. The informant himself has produced a magazine with live cartridge and no offence

Patna High Court CR. MISC. No.13403 of 2025(2) dt.07-03-2025 2/3 under any of the provisions of Arms Act is made out against the petitioner. Petitioner has no role in the alleged occurrence. Moreover, the parties have compromised the matter. Petitioner is in custody since 26.11.2024 and charge-sheet has been submitted. Petitioner is having antecedent of two more cases in which he is on bail.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner as well as submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul/concerned court in connection with Triveniganj P.S. Case No. 300 of 2024, subject to the conditions mentioned in Section 437(3) of the Code of Criminal Procedure and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
