JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 504, 354 of the Indian Penal Code and Section 3⁄4 of the Prevention of Witch Practices Act.
The prosecution case is that the accused persons including the petitioner came to the house of the complainant and addressed her as witch and on protest being made the petitioner tore the blouse of the complainant. It is further alleged that accused persons took away the household articles along with the cash from the house of the complainant. It is submitted by learned counsel for the petitioner that petitioner is agnate of the complainant and maliciously the accusation has been levelled in the background of land dispute. From the accusation levelled in the complaint,
Patna High Court Cr.Misc. No.6961 of 2016 (2) dt.16-02-2016 2/2 no offence under Section 354 I.P.C is made out. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation and the fact that petitioner is agnate of the complainant, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ara in connection with Trial No. 4044 of 2013, Complaint Case No. 1749(C) of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
