JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 21-08-2023 Heard Mr. Shiv Kumar, learned counsel appearing on behalf of the petitioner; Mr. Mujtabaul Haque, learned GP-12 along with Mr. Manish Kumar, learned AC to GP-12 for the State.

2. Learned counsel appearing on behalf of the State informs that all the formalities relating to sanction of due pension to the petitioner in accordance with law has been taken by the Civil Surgeon, Gaya vide Letter No. 2571 dated 04.08.2023.

3. The Additional Chief Secretary, Health

Patna High Court CWJC No.4457 of 2023 dt.21-08-2023 2/2 Department, Bihar is directed to take immediate steps to direct the sanctioning authority to sanction pension of the petitioner for its fixation by the Accountant General, Bihar. The above exercise may preferably be done within a period of three weeks.

4. In case, the petitioner is still aggrieved for nonpayment of any retiral dues on any head, in that case, the petitioner is at liberty to file a detailed representation before the appropriate authority. The concerned authority is directed to dispose of the representation and ensure to make payment, if any is required to be paid to the petitioner in accordance with law within a period of six weeks. The District Provident Fund Officer, Gaya is directed to collect the deduction statement from all the places of posting of the petitioner within a period of six weeks and ensure to make payment of remaining amount of provident fund along with statutory interest. within the aforesaid period

5. The writ petition, accordingly, stands disposed of.
