JUSTICE BIRENDRA KUMAR ORAL ORDER 27-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 302, 201 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Father of the informant had left the house along with this petitioner and co-accused Mukesh Yadav and in the morning his dead body was recovered. Hence, the petitioner and Mukesh Yadav are under suspicion.

Submission of the petitioner is that there is no eye witness to the occurrence. The petitioner is in custody since 10.11.2016 and only material is confessional statement of coaccused.

Patna High Court Cr.Misc. No.6427 of 2017 (3) dt.27-03-2017 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Naugachhia, Bhagalpur/Successor Court, in connection with Parbatta P.S. Case No.107 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
