2. The petitioner apprehends his arrest in a case registered for offence under Sections 323, 341, 354-B, 363 and 366-A/34 of the I.P.C. and Section 8 / 12 of the P.O.C.S.O. Act.

3. This petitioner is alleged to have kidnapped the minor daughter of the informant for unlawful purpose.

4. It is submitted on behalf of petitioner that the victim, in her statement recorded under Section 164 Cr.P.C., has denied the prosecution case and specifically stated that she was in love with this petitioner and on her own sweet will without informing anyone in her house, she fled and solemnized marriage with him. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the statement of the victim recorded under Section 164 Cr.P.C., let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - VI cum Special Judge, POCSO Act, West Champaran at Bettiah in connection with Jogapatti P.S. Case No. 435 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
