JUSTICE PURNENDU SINGH ORAL ORDER 08-12-2021 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. Petitioner who is in custody since 08.01.2021 seeks regular bail in connection with Patori P.S. Case No. 380 of 2016 registered for offences punishable under Sections 341, 323, 324, 379, 147, 148, 504 and 307 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the present case has been filed as a counter to the case he had filed in connection with Patori P.S. Case NO. 379 of 2016 against the informant and petitioner has been implicated in the present case along with other family members. He further submits that although there is an allegation of loan of certain amount to be paid by the petitioner but in this respect, from the perusal of the FIR, no evidence has been brought on record. Patna High Court CR. MISC. No.25549 of 2021(4) dt.08-12-2021 2/3 further submits that petitioner is in custody since 08.01.2021 and he has clean criminal antecedent.
Learned A.P.P. appearing on behalf of the State submits that petitioner has assaulted the informant and his daughter. He further submits that there is general and omnibus allegation against the petitioner and nothing specific is against the petitioner in the case diary.
Considering the above mentioned facts and circumstances of the case and rival submission of the parties as well as case and counter case between the parties, let the petitioner above named, be released on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur in connection with Patori P.S. Case No. 380 of 2016 subject to the following conditions:
(i) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
(ii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court. (iii) If the petitioner tempers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty
