JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody since 02.08.2021 in a case registered for the offences punishable under Sections 341, 323, 493, 504 of the Indian Penal Code.

It is alleged against the petitioner that on promise to marry, the petitioner has established physical relationship with the informant and continued it for two years but thereafter he refused to get marry with her. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

The petitioner and the informant are resident of the same village and for the purpose of marriage with the petitioner, this false case has been lodged against him. The informant is a married woman. She is major and the physical relationship, if any, is consensual. Moreover, the petitioner is in custody since 02.08.2021.

Considering the nature of accusation and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 376 of 2021.
